Minnesota Creates a New Medicare Supplement Guaranteed Issue Opportunity Beginning August 1, 2026

Minnesota has introduced one of the most significant Medicare Supplement changes in years.

Beginning August 1, 2026, certain Minnesota Medicare beneficiaries will have a new one-time Guaranteed Issue opportunity to enroll in a Medicare Supplement (Medigap) plan without answering health questions or going through medical underwriting.

For many people who previously believed they were “locked out” of changing Medicare Supplement plans because of health conditions, this new law may provide an important opportunity.

Here’s what you need to know.

New Medicare Supplement Rule

What Is Changing?

Under Minnesota’s new law, eligible Minnesota residents ages 65 through 70 who meet the state’s requirements will have a one-time annual Guaranteed Issue opportunity to enroll in a Medicare Supplement plan offered by any participating carrier.

Guaranteed Issue means:

  • No medical underwriting
  • No health questions
  • Coverage cannot be denied because of pre-existing medical conditions (provided you qualify under the law)

This represents a major change for many Medicare beneficiaries who previously would have needed to medically qualify when changing Medicare Supplement plans.

When Can You Use This New Opportunity?

Eligible beneficiaries may apply during either of these enrollment periods:

  • Annual Enrollment Period (AEP): October 15 – December 7
  • Medicare Advantage Open Enrollment Period (MA OEP): January 1 – March 31

These enrollment periods now provide more than just Medicare Advantage and Part D options—they may also allow eligible Minnesotans to move into a Medicare Supplement plan using this new Guaranteed Issue protection.

This Benefit Can Only Be Used Once

One of the most important details is that this annual Guaranteed Issue opportunity is available only one time.

Because this is a lifetime opportunity, it’s important to carefully compare plans, premiums, and long-term needs before using it.

Working with a knowledgeable Minnesota Medicare advisor can help you determine whether this is the right time to exercise your Guaranteed Issue right.

Do You Need to Provide Documentation?

For applications submitted during the qualifying enrollment periods under this new Guaranteed Issue opportunity:

  • No additional documentation is required to establish eligibility.

However:

  • Individuals qualifying because they are institutionalized continue to have year-round Guaranteed Issue rights under existing Minnesota law.
  • Those applicants must still provide documentation verifying their eligibility.

Could Premiums Be Higher?

Possibly.

Minnesota law allows insurance companies to apply a premium surcharge above the standard community-rated premium for beneficiaries using this new Guaranteed Issue opportunity.

Important points:

  • The surcharge amount varies.
  • It depends on the year in which you enroll.
  • Each insurance company will explain how it applies the new law.

Before enrolling, be sure you understand:

  • Your monthly premium
  • Any applicable surcharge
  • Long-term costs
  • Available carrier options

Why This Change Matters

This new law gives many Minnesotans something they have never had before:

A chance to enroll in a Medicare Supplement plan without medical underwriting, even if they may not have qualified in the past.

If you’ve remained in a Medicare Advantage plan primarily because you were concerned about qualifying medically for a Medicare Supplement, this new law may create additional choices.

It won’t be the best option for everyone, but it is an important opportunity that deserves careful evaluation.

Should You Consider Using This New Guaranteed Issue Right?

Every Medicare situation is different.

Questions to consider include:

  • Have your healthcare needs changed?
  • Are you satisfied with your current Medicare coverage?
  • Would a Medicare Supplement better fit your lifestyle?
  • Have you previously been unable to qualify because of medical underwriting?
  • Is this the right year to use your one-time Guaranteed Issue opportunity?

Because this benefit may only be used once, understanding your options before making a decision is especially important.
